This Membership Agreement ("Agreement") is made and entered into digitally between the users ("Member") who wish to benefit from the services provided on [www.modelturkey.com](http://www.modelturkey.com), [www.turkiyemodel.com](http://www.turkiyemodel.com), and [www.devasamedia.com](http://www.devasamedia.com) (collectively, the "Platform") and the legal owner of the sites, Devasa Media – Yusuf ATAK ("Company"), in accordance with Turkish Law.

1. PURPOSE AND SCOPE

This Agreement regulates the terms and conditions under which the Member can use the services offered by the Platform, and defines the rights and obligations of the parties.

2. MEMBERSHIP ELIGIBILITY

Membership is open only to individuals who are 18 years or older. Minors may only register as Child Members (Model, Actor, etc.) with the consent and responsibility of their legal guardian.
* Access for minors is to be managed exclusively by their legal representatives.
* The Company is not obliged to verify the accuracy of the age and identification information provided by the user. Any false information is solely the responsibility of the user or their legal representative.
* The Company holds no special responsibility for the membership of minors; all responsibility lies with the parent or legal guardian.

3. MEMBERSHIP TYPES AND SERVICES

The Company offers various membership plans for different user groups. Each plan may include different fees, rights, and services. Members declare that they have reviewed and accepted the details of the plans before subscribing.

4. MEMBERSHIP TERMINATION AND REFUND

* Members may cancel their accounts at any time.
* No membership fee is refundable.Membership is considered active from the moment the service begins.
* Even if the Member deletes their account or cancels their membership, they cannot claim any refund for payments previously made.
* The Member agrees that content uploaded to the Platform (photos, videos, biography, etc.) can be archived, promoted, and used for advertising by the Company indefinitely.

5. TERMS OF USE

* Members commit to using the Platform only for lawful purposes.
* No content on the Platform may be reproduced, distributed, or copied without permission.
* The Company reserves the right to monitor, remove, or edit content and account information.

6. LIMITATION OF LIABILITY

* The Company is not liable for damages arising from the actions of third parties or other users.
* Members accept full responsibility for all transactions carried out on the Platform.

7. PERSONAL DATA AND PRIVACY

* All personal data provided by Members is processed and protected under the Company’s Privacy Policy.

8. CHANGE OF AGREEMENT

* The Company may unilaterally modify this Agreement at any time.
* Updated provisions become effective once published on the Platform.
* Members are responsible for regularly reviewing changes; silence constitutes acceptance.

9. INTELLECTUAL PROPERTY

* All designs, databases, brands, logos, and content on the Platform are the property of the Company.
* Unauthorized use is subject to civil and criminal penalties under Turkish Intellectual and Artistic Works Law (Law No. 5846).

10. COMMENT AND RATING RESTRICTIONS

* Member ratings and comments are visible only to authorized parties (e.g., employers) and may not be shared with other users or platforms.
* Violation of this rule may result in membership termination and legal sanctions. The Company reserves the right to set penalty amounts unilaterally.

11. PENALTY CLAUSES

* The Company may determine fines or penalties for violations of this Agreement.
* Penalties may include but are not limited to temporary suspension, content removal, or termination of membership.
* The amounts are determined solely by the Company and are binding on the Member.

12. DISPUTE RESOLUTION

* This Agreement is governed by the laws of the Republic of Turkey.
* Any disputes arising from this Agreement are subject to the competent courts and enforcement offices in Ankara, Turkey.

13. COMMISSION AND PAYMENTS

* Members understand that the Company may deduct a commission from payments related to services provided through the Platform.
* Even if membership is terminated, cancelled, or removed, the Company retains the right to collect the agreed commission.

14. FORCE MAJEURE

* The Company is not liable for delays or failures caused by events beyond its reasonable control, including but not limited to natural disasters, governmental actions, or technical failures.

By electronically approving this Agreement, the Member acknowledges that they have read, understood, and accepted all provisions of this Agreement. The Agreement becomes effective immediately upon the Member’s electronic approval.
